Joint statement: Wotton v State of Queensland

I am pleased to announce today that the parties in Wotton v State of Queensland have agreed to a settlement scheme and an apology, subject to the court’s approval.

We will now endeavour to work with the Palm Island community on a fitting way to recognise this historic apology.

I know that for many Palm Islanders this was an incredibly difficult time in their history. I look forward to continuing to work closely with the community as we move forward together.

In her December 2016 ruling in the Federal Court, Justice Mortimer found in favour of Lex, Cecilia and Agnes Wotton, and ruled that the conduct of certain QPS officers in 2004 contravened section 9(1) Racial Discrimination Act 1975 and that the actions of certain police were found to be unlawful.

The parties have agreed on a $30 million settlement for 447 claimants, including interest, applicants’ legal costs, and administrative costs, and the delivery of an apology.

The parties will now apply to the court to seek to have the settlement approved.

Assuming the court approves the settlement, I know that all parties involved in this settlement hope it will provide some measure of closure and a way forward for the community of Palm Island.
