Discussion paper on building industry payment disputes

Minister for Public Works and Housing Tim Mander has released a discussion paper about payment dispute resolution in the Queensland building industry.

The paper, Payment Dispute Resolution in the Queensland Building and Construction Industry, is examining the operations of the Building and Construction Industry Payments Act 2004 (BCIPA). 

“The paper is seeking feedback from industry stakeholders, head contractors, subcontractors and suppliers about the operations of the BCIPA,” Mr Mander said.   

The BCIPA was created in 2004 to provide an alternative adjudication process to the court system for resolving payment disputes in the building industry.

Mr Mander said it gave people performing construction work or supplying related goods or services statutory entitlements to receive and, if necessary, recover progress payments.  

“The BCIPA has been in operation for more than eight years and the Government believes it is appropriate for a comprehensive review to be undertaken into its effectiveness,” he said. 

“I encourage all interested parties to make a submission." 

The Government has appointed barrister and building industry expert Andrew Wallace to analyse the submissions and to undertake targeted consultation with industry. 

Submissions and comment are sought by 22 February 2013.
