Shine Appeals Sentence for Cairns Driver

Attorney-General and Minister for Justice Kerry Shine will appeal the sentence of a woman convicted of killing a pedestrian while driving intoxicated in Cairns.

Mr Shine said he was appealing the four-and-a-half year prison sentence given to Gemma Anne Hodges on the basis it was manifestly inadequate.

“I have read the Judge’s sentencing remarks and after receiving advice from the Director of Public Prosecutions I have decided to appeal the sentence,” Mr Shine said.

“I do not believe the sentence adequately reflects the gravity of the offence and it also fails to sufficiently take into account the aspect of general deterrence.”

Mr Shine said he’d received advice on sentences handed down in similar cases and believed the sentence handed down in this case was not in line with those precedents.
