Life Ban for Real Estate Agent
A Gladstone real estate agent has been handed a lifetime ban for misleading consumers and operating outside his licence restrictions.
The Commercial and Consumer Tribunal has permanently banned Kevin John Brandt from holding a real estate licence or certificate under the Property Agents and Motor Dealers Act 2000.
Attorney-General and Minister for Justice Kerry Shine welcomed the tribunal’s decision.
“This decision effectively stops Mr Brandt from ever operating again as a real estate agent in Queensland,” Mr Shine said.
"Mr Brant had represented himself as a fully-fledged real estate agent.
“This was simply not the case - his licence was restricted and subject to the condition that he have no dealings with trust accounts.
“Not only did he deal in trust accounts he also engaged in misleading conduct displaying a fraudulent real estate certificate on his wall.
“This is not accidental or incidental behaviour on the part of this individual.”
Mr Shine said the Office of Fair Trading was committed to exposing rogue operators and prosecuting them to the full extent of the law.
“Queenslanders deserve to know they are dealing with reputable agents," he said.
“This decision is a clear reminder to all real estate agents to act responsibly.
“If an agent chooses to breach the law by deceiving their customers, they risk the loss of their licence, reputation and livelihood.
“The legislation is there to protect businesses and clients, and must be complied with. Licensees caught doing the wrong thing will be penalised.”
