Foy back behind bars

Corrective Services Minister Judy Spence said the arrest of Mark Foy who is subject to a Dangerous Prisoner Sexual Offenders Act order (DPSOA) shows that surveillance monitoring of these offenders is working.

Ms Spence said: “I know the Corrective Services Department was disappointed last year when the Supreme Court allowed Mr Foy to attend licensed premises for karaoke.

“The Court also ruled that electronic monitoring and a curfew would be draconian

“Corrective Services had argued that these measures were necessary.

“Foy was arrested at 4.45pm at his Wacol residence for breaches of his parole order and was taken to the Brisbane Watchhouse.

“Foy will remain in custody until the parole board considers in the case.

“At this stage he has failed an initial drug test. Confirmatory testing is yet to be completed.

“If that testing confirms the presence of drugs the Government will seek to have him charged for breaching his DPSOA order.

“And the Government would apply for a continuing detention order,” Ms Spence said.

Foy served 4 years 6 months for indecent treatment of a child under 16 years and was released under the Dangerous Prisoners (Sexual Offenders) Act.

He was issued with a DPSOA supervision order on 5 January 2005 with the order due to expire on 31 December 2014, a period of approximately 10 years.

In March 2007 he faced drug and assault charges and received a 21 month sentence. He served four months’ prison and was released to parole on 27 July 2007.
