Views Sought on Proposed Changes to Body Corporate Regulations

Proposed changes to the laws governing how bodies corporate operate in Queensland are now available for public comment.

Attorney-General and Minister for Justice Kerry Shine today released a regulatory impact statement for new rules relating to the operation of community titles schemes – a flexible arrangement where a person can privately own an area of land or building as well as share common property areas with other owners.

“The current regulations that support the Body Corporate and Community Management Act 1997 will expire in September, so it was time to comprehensively review their effectiveness and relevance,” Mr Shine said.

“The most significant change is the proposed creation of a regulation to govern schemes with only two lots.

“This will effectively simplify the processes for the respective owners, for example they will be able to make decisions by written agreement instead of having to hold a general meeting and agree between themselves about how to fund the maintenance of common property and other expenses.

“These regulations will impact on owners of property such as townhouses, duplexes, high-rise apartment complexes, retirement villages, hotels, resorts, shopping centres, commercial offices, as well as mixed retail and residential unit complexes.

“I would encourage anyone with an interest to have their say before the March 14 deadline.”

Mr Shine said community living was an increasingly popular lifestyle choice for many Queenslanders.

“Our state has more than 35,000 schemes, comprising more than 324,000 lots,” he said.

“The number of schemes has risen significantly in the past decade and will continue to grow with increased mixed-use or medium to high-level density living to help accommodate our growing population.”
