Shine Accepts Court's Decision on Sebo Appeal

Attorney-General and Minister for Justice Kerry Shine said he accepts today’s Court of Appeal decision to dismiss his appeal against the manslaughter sentence handed to Damian Karl Sebo.

"I believe that it was in the public interest that the sentence imposed on Mr Sebo be reviewed by the Court of Appeal. I accept the decision of the Court of Appeal," Mr Shine said.

“This case which has centred around the murder defence of provocation.”

“In October I released a discussion paper addressing the provocation defence for murder trials and the accident defence for murder and manslaughter trials.

“The discussion paper was sent to a range of stakeholders, including the judiciary, legal profession, victims’ groups and others who have expressed an interest to me and members of the public were also encouraged to provide comment.

“It is vital that justice remains in step with community expectations and I welcome views from all sectors of the community on these important legal issues so that all options can be identified and considered.”

“The deadline for submissions on the discussion paper is next Monday 3rd December.”

Mr Shine said he will consider the submissions once they have all been receive.
