Public’s views sought in review of juvenile justice system

Advocates of the “name and shame” approach to punishing young offenders will have the chance to recommend their views to an upcoming review of the State’s youth justice system.
Communities and Youth Minister Warren Pitt said Queensland’s Juvenile Justice Act would go under the microscope as part of the review.
“The purpose of the review is to ensure a continuing “best practice” approach to Queensland’s youth justice system”, Mr Pitt said.
“The review provides an opportunity to assess current legislation to gauge how effective our existing laws are in addressing juvenile crime and other aspects of the youth justice system,” he said.
“It also provides an opportunity for government to listen to the ideas and suggestions of Queenslanders in relation to youth justice matters.”
“For example, the issue of naming young offenders crops up from time to time.
“The current legislation includes provision for the courts to determine that an offender be named where an especially serious and violent crime is involved, and it is considered in the interests of justice for the young person to be named.
“Some people would like to see this provision widened to permit the naming of greater numbers of young offenders, whereas others believe the law is fine as it stands.
“This review gives people the chance to put their views forward on how the current laws can be changed and improved.
“All views will be considered, although I should say preference will be given to those that are backed by some evidence to indicate they are likely to work,” Mr Pitt said.
Mr Pitt today announced the terms of reference for the review and released an issues paper outlining the main issues for discussion.

Mr Pitt said the review would examine the effectiveness of the current legislation and focus on specific areas including the existing range of sentencing options, the causes of high levels of young people on remand, and ways to address these issues.
“Another aspect the review will focus on is the transitioning of young people from detention into the community,” he said.
“The review will also explore legislative options aimed at reducing the rate at which Aboriginal and Torres Strait Islander young people come into contact with the Queensland criminal justice system.
“I encourage all relevant agencies, organisations, individuals, families, interest groups and community organisations to participate in this important review before submissions close on Friday 19 October 2007.”
The Department will also consider the findings of any relevant research, reviews or evaluations relating to contemporary youth justice practice, to ensure the review is based firmly in youth justice research and evidence.
