Johnstone Shire decision reserved: Fraser
The Supreme Court in Cairns has today reserved its decision on an injunction sought by two Councillors from the Johnstone Shire Council.
Local Government and Planning Minister Andrew Fraser said that meant he was prevented from making a decision on the Council’s future - based on the recommendations of his Department – until the Court returned with its decision.
“I remain firmly of the view that these two Councillors should not have commenced these proceedings in the first place,” Mr Fraser said.
Mr Fraser said once the court decision was made he would be able to decide on the recommendations of the department based on a report which was this week also provided to the Johnstone Shire Council.
“The report was provided to the Council to afford them natural justice.
“I have said – repeatedly – from the outset that this decision making process is a weighty one and it is a decision that I have assured the Council I will make lawfully and in a manner that affords them that natural justice.”
The Johnstone Shire Council has, for some time, been at the centre of serious allegations and concerns regarding bullying and intimidation, meeting procedures and staff morale.
In August the Council was issued a Show Cause Notice requiring it to address the matters of concern, including strategies for resolving those concerns. Subsequently the two Councillors launched their Supreme Court action.
